Evidence Kuhn Parinyanuch ended relationship for other reasons Evidence Kuhn Parinyanuch "expected" (pre-planned?) the marriage to fail multiple insults to me from Kuhn Kaew, proxy insult from Kuhn Parinyanuch, Kuhn Parinyanuch secretly insult me to her brother Kuhn Parinyanuch insult her own father by not inviting him to our wedding Kuhn Parinyanuch knew about and accepted imperfect relationship between me and her brother Kaew, prior to marriage. The claim of "looked down and insulted her family" is generally a claim of unsuitability. To make a claim of unsuitability, Kuhn Parinyanuch must be suitable as a partner. anger issues towards me and others threat issues mean-spiritedness/insulting comments lack of integrity Kuhn Parinyanuch's (subsequent) allegations with evidence links: 4) Defendant claims I accepted 20THB of gold (allegation Sin Sod was returned to me). This is in direct conflict of claim #2 No additional evidence needed. 1) The relationship a) Chronology i) we first met in 2001 ii) we re-met in 2006 iii) during relationship, K. P was given unquestioned ATM access iv) during relationship, K. P was given unquestioned credit card use (charges in USD) v) K. P was given many trips/vacations including First/Business class tickets and luxury trip to Maldives vi) I gave K. P 152K THB towards her Masters degree tuition, as an investment in our future vii) I also gave K. P many expensive gifts during our relationship - diamond jewelry - gold jewelry - 1 baht gold bar (1 year wedding anniversary gift) - Sony Vaio laptop - Nine West/Coach/Kate Spade purses and handbags - HTC-S620, Blackberry 8900, iPhone4 - Canon G12 camera - delivered flowers - cosmetics - etc.. b) me visiting her family/relatives from 2006 to 2012 (photos) c) talk of getting married began in 2010 i) chat showing we had discussion which referenced marriage, Sin Sod, and Klong Man in 2010 (chat 1, 29/8/2010) (chat 2, 30/8/2010) (chat 3, 2/9/2010) ii) itemized email showing anticipated costs for Sin Sod and Klong Man iii) my reference to Sin Sod being 1M in chat with Parinyanuch (17/5/2010) d) (Thai) wedding date and planning under the full control of K. P i) I agreed to the date, I arrived early, I assisted with preparation, and I fully cooperated with all requests e) morning ceremony and evening reception took place on 28/8/2011 i) Sin Sod was presented to Kuhn Chatsaneeya with a value of 1M THB - 500K THB in gold (10 2-baht gold bars) - 500K THB in cash ii) Klong Man was presented to Kuhn Parinyanuch with a value of 342K - 6 baht Thai gold (necklace and two bracelets(1) (2) (all 4)) - diamond engagement ring - gold/platinum wedding band iii) full collection of morning ceremony photos iv) testify that wedding gifts were conditional gifts v) testify to the pre-marital agreement that 500K would be returned to me, after the ceremony vi) show that 378K THB was returned to me vii) show that Sin Sod and Klong Man were funded with money from my retirement savings, loan, and credit card purchase viii) evening reception photos ix) mini-honeymoon in Hua Hin 2) intent to legally marry in US a) testify that we discussed getting (legally) married in the US and we started the process b) Parinyanuch signed booklet which contained notice of need for marriage license and page she signed states she agrees that she read the booklet in full c) State of Michigan Marriage License Law i) Section 551-101 - Michigan state law requiring marriage license ii) Section 551-106 - penalty for performing marriage without a license d) Parinyanuch was interviewed by an ordained Catholic priest and signed a sworn application on 27/3/2012 e) Parinyanuch personally filled out a portion of I-129F fiance petition i) application states she will live in Illinois with me (same page) ii) application states she will apply for a visa in Bangkok (same page) iii) at my request, Parinyanuch provided "passport-style" photos to be submitted (required) with I-129F fiance application iv) at my request, Parinyanuch provided her passport to me, to scan proof of her visits to the US f) Parinyanuch visited St. Joseph church in Michigan (with me) and spoke with the Monsignor (working on Affidavit from Monsignor) g) while she was in the US, Parinyanuch was asked to do three things as soon as possible, upon returning home i) G-325a background check application ii) Affidavit of freedom to marry iii) online relationship questionnaire required by my church 3) evidence of 'change of heart' started to appear right after Parinyanuch returned to Thailand on 1/4/2012 The following things were occuring just after her visit to the US in March 2012, but before any issues with Kaew. I believe offering this explanation in my initial testimony, might help undermine the impact of Parinyanuch claiming that I insulted and looked down on her family, as being the cause of the relationship failure. Essentially, I wish to pre-establish that there appears to be a different reason she ended the relationship, which had nothing to do with her family (Kaew). a) resistance to discussing specific US wedding date (16/4/2012) b) Parinyanuch indicates there are reasons to not discuss wedding date, but refuses to explain what they are (16/4/2012) i) "still many things in my head perhaps" ii) "I still need to run my own sequence first.." iii) "Too many things in my head.." iv) "So I donno..kinda messed" c) anger flares i) chat on 10/4/12 "So many issues lately!!!!!! [angry face]" ii) chat on 11/4/12 ("I am FUCKING stuck in traffic") d) when Parinyanuch return to Thailand, she tell me (10/4/2012): - she experience loss of appetite - she miss Thai spice after only a few days in US - she express boredom with herself e) no known progress on Parinyanuch's tasks needed for US wedding, more than two weeks after her return home i) I asked her if her G325a is ready for review (near end of chat session, 16/4/2012) ii) I received email that K. Parinyanuch has not started her FOCCUS test (18/6/2012) iii) testify that her procrastination on her wedding preparation activities, created the conditions for me to occasionally question her activities after work (?) f) with the end of her studies and the resumption of having free time to spend going out and having fun with friends, possibly she has simply changed her mind about being married and moving to the US, and is now looking for an excuse to end the relationship i) "I do not see any support", "U failed" (in 16/5/2012 chat, she complain about lack of financial support as stated in her 'family plan') ii) again, Parinyanuch try to claim lack of 'support' iii) Parinyanuch insult me by saying on 17/5/2012 that she believe she will starve if she move to US ("I do not wish to spend my life starving and I think I am not ok with you.") iv) Parinyanuch believes I ruined her reputation as a married woman, even though she is the one who chose to end our relationship/breech engagement g) in an email I received from her brother Kaew (22/4/12), Kaew explains belief that Parinyanuch is unhappy because she is leaving her family, her friends, her favorite foods, life style, and other things (to be with me). 4) Parinyanuch stated she has made a final decision to end our relationship a) after spending only 29 days with me, as my wife... b) Parinyanuch made a 'final' decision to end our relationship, via chat on 18/5/2012 5) my requests for the return of Sin Sod/Klong Man a) my request in June of 2012 and K. P's initial response continued in email #1 continued in email #2 continued in email #3 b) my request in Sept of 2012 and K. P response c) my request in October 2012 via a letter from Ms. S (no response from K. Parinyanuch) d) case filed in November of 2012 6) my attempts to restore our relationship a) work with Kaew (Parinyanuch's brother) discreetly and openly i) met with Kaew and his gf in July 2012, to talk about how to repair my relationship with Parinyanuch (chat 1) (chat 2) (chat 3) ii) secret graduation gift (iPhone 4S) for Parinyanuch - gift to Parinyanuch approved by Kaew - I was asked to promise to never tell Parinyanuch that iPhone was from me - chat also includes my strong desire to visit Chatsaneeya to show my respects, but I was told I should avoid visiting Chinnakate, because Chatsaneeya was very angry. Something tells me Chatsaneeya had no knowledge about what was going on, and that this was simply a move to block communication between me and Chatsaneeya, so that she would not learn what was going on. iii) helping her family and in particular, her brother Kaew, in Phatthalung (August 2012) per request of Parinyanuch in her "family plan" b) testimony regarding weight loss/improved eating habits c) 1-year anniversary gift of gold (1 baht) and other gifts (lotions, designer handbags, etc..) d) I wrote a draft letter to Chatsaneeya in August of 2012, but Kaew told me not to send it 7) Parinyanuch Phetnoi's unsuitability as a partner a) anger issues towards me and others i) Moss - this particular chat session is a very revealing view of how Parinyanuch thinks and resolves conflict - I recommend reading the entire chat - "Coz I don't wanna aim and hurt wrong target", "Such a sad but she DESERVED it.. [devil face]", "My evil part now start [winky]" - she reveals that "I am not kind of person who try to be nice to someone not being nice to me first", and "I don't need explaination. Only I need is 'WHO'" ii) Kwan & Aoi - referenced in conversation about Moss, plus my testimony iii) neighbor of Kwan that accidentally damaged Parinyanuch's car ("Now it is a time to show my dark side..[angry face]") iv) "I HATE YOU" (hatred of me, 24/4/2012) v) even simple questions can trigger anger from Parinyanuch - I simply ask if selection of wedding day was near graduation of her best friend for a reason, I express concern for her workload and suggest consideration for a few month delay for ceremony until after she finish her Masters degree studies. In reply, she threaten to cancel "everything". In same conversation, I ask what the temperature is in Bangkok, and somehow this create problem. (27/3/2011) - I simply question her blackberry status (10/4/2012) vi) vulgar/offensive language - "I am FUCKING stuck in traffic" (11/4/2012) - "Kaew said...GET LOST.. And go FUCK yourself !!", "WHO the fuck are you???", "Where the fuck have u been?" - "Since u love only yourself and your fucking communication that is not effective..", "Have a fucking day!!" - my reply (24/4/2012) - "Oh my fucking GOD!!!!!", "Have a fucking dream day..", "Then better stay with your fucking self!!!" (27/4/2012) - "What did u send to Kaew..STILL fucking remeber", "And other are fucking dump and bad behavior in your eyes", "I do not DIG up any fucking EVIDENCE", "Fucking hate u know that" (16/5/2012) b) threat issues i) "There is no warrantee about your safety in BKK." (threat to my personal safety, 24/4/2012) ii) threats to end chat - 4/10/12 chat "maybe I should stop using BB" - 4/11/12 chat "Maybe I should stop using BB for a few day?" iii) threat to cancel morning/evening ceremonies because I suggest waiting until after she finish her degree (27/3/2011) iv) threat to cancel our marriage if I say "one word" about her (see "About problem solving") v) in response to me offering to discuss settlement in a way where we can "listen, think, and speak clearly, calmly, and respectfully", Parinyanuch responded with threats to my job and apparent attempted extortion c) mean-spiritedness/insulting comments i) multiple insults (3/9/2012) - "Marriage can end just like a party." - "But at least we are lucky enough that we have not registered as husband and wife(legally)..good news...!!" "You still have chance and so do I." -- Parinyanuch is not concerned about her reputation - she claims it is good news that we are not legally married, and still have another opportunity -- This shows Parinyanuch is not upset about her reputation - this is Parinyanuch seeing an opportunity (good news) to quickly acquire money without earning it, by keeping Sin Sod and Klong Man, similar to our chat on 7/2/2012, when I wanted to talk about planning our US wedding, she was more interested in talking about rumored EM sale of her work unit "because I will get lots of money... Like almost milliom" - "Marriage is like buying lottery, some couples win and some loose." -- Again, a reference to quick, easy money... and she expects to win - "Sorry again that our relationship failed faster than expected." -- Parinyanuch admits (with a hollow apology) that she "expected" our relationship to fail -- When did she expect it to fail? -- How did she expect it to fail? -- When did she come to this conclusion? Why did she come to this conclusion? -- Her answers could show evidence of pre-meditated fraud ii) "And i would have to agreed that the gap between ages ARE very important." (I have no idea who she is agreeing with - I don't remember age ever being brought up as an issue in our relationship; 9/9/2012) iii) "Go back and re-read..u have such a big barrier understand english and the comparison." (24/4/2012) iv) "This is best u can think??" (19/4/2012) v) I am informed she will not have children for two years (see "About kid", 1/5/2012) vi) "I am not invite u to my graduation ceremony" vii) chat on 17/5/2012 - "You still cannot feed yourself for the entire of month" - "I see instability on your financial" - "I do not wish to spend my life starving and I think I am not ok with you." xi) "...there is no such event. Are we really married??" (Parinyanuch insulted the existence of our ceremony because she forgot we had a honeymoon in Hua Hin) xii) "U got alzeimer?", "U so dumb" (27/4/2012) d) lack of integrity i) unwillingness to return Sin Sod and Klong Man upon request ii) accepted anniversary gift of gold, under false pretense iii) admits to bad behavior without embarrasment - "it is my bad behavior..so??" (19/4/2012) - in response to my recommendation for her to stop her bad behavior, she said, "No need to convince to me..I don't care about others..I still insist my word..", and "Who care" - "Per say, my behavior is not best as well" (3/9/2012) iv) walked away from a lifelong commitment made in front of more than 200 friends and relatives, after spending only 29 days with me, as my wife v) failure to disclose monetary gifts (cash) received during evening reception - to the best of my knowledge, these gifts in total, were roughly equivalent to the cost of the evening reception. (caution: bringing this up prior to testimony, is likely to result in Parinyanuch claiming that she gave the money to me, or we divided the money between us - neither of which are true) vi) claimed in initial pleading that gifts were unconditional because marriage was never to be registered, but then subsequently admitted some gifts were returned to me vii) changed allegation that I declined to accept Sin Sod gold (which never happened), to that I did accept and keep Sin Sod gold (which also never happened). viii) Parinyanuch chose to "marry" me Parinyanuch chose to plan the entire wedding (morning and evening) Parinyanuch chose to invite more than 200 of her friends and relatives Parinyanuch chose to accept Klong Man from me Parinyanuch then insults me, threatens me, uses vulgar language towards me, and ends her relationship with me and then Parinyanuch demanded 10M, then 20M baht from me, because it is somehow my fault she is now known as a married woman - I did not force her to marry me, and I did not force her to end her relationship with me e) controlling/demanding i) "my family visit are not allow from now on" ii) I list a number of examples of her demands iii) I list a number of examples of her attempts to control me 8) I respectfully request that the court consider the following extenuating circumstances: a) my age (substantially reduced ability to find a new partner of child-bearing age) b) I spent many years spending hundreds of thousands buying a variety of gifts for her, and even paid 150K THB towards her Masters degree as an investment in our future, and now that she has all of these things (plus Sin Sod and Klong Man), she walks away c) Parinyanuch (and her family) has considerable wealth in property and education (Masters), and will have no problem attracting a new mate - indeed, I believe it is this assessment which has allowed Parinyanuch to walk away so easily d) I now have debt I must pay back for many years, due to the purchase of Sin Sod and Klong Man I am not a desirable mate, with the amount of debt incurred as a result of my relationship with Parinyanuch e) my parents are in poor health and are now unlikely to see me ever get married f) my one living grandmother is 94 years old and is now very unlikely to see me ever get married g) during my courtship of Parinyanuch, three close relatives of mine, have died; flowers were sent "from John and Perri" to all three funerals - my maternal grandmother - 5/4/2008 - my maternal uncle - 12/1/2011 - my paternal aunt - 30/6/2011 h) I helped give Parinyanuch the wedding she wanted - I was not given the wedding that I wanted i) I am now embarrassed in front of my friends, my family, and my church Questions/issues: Conflicted evidence from Parinyanuch: a) In her original response, Parinyanuch seemed to claim conflicting positions. She first stating the wedding was never to be registered, so what I gave was an unconditional gift, but then she also claims, that part of Sin Sod was returned to me, and in her counter-claim, she indicated half of the gold was also given to me. Why would anything be returned to me if it were an unconditional gift? Shouldn't she be required to pick one defense or the other? b) In her original claim, my understanding is that Kuhn Parinyanuch alleged that I accepted 500K cash and declined gold that was offered to me (presumably after the ceremony). In her counter-claim filed in February, she appears to be claiming I was offered and accepted both the 500,000 cash and 20 baht of gold. Interesting questions to be asked of Parinyanuch: a) why did I only receive 378,000 and not the full 500,000 on 6/9/2011? b) who allegedly offered Sin Sod cash to me? when did this occur? c) who allegedly offered Sin Sod gold to me? when did this occur? ----- In response to K. Parinyanuch's allegation of insulting and looking down on her family (her brother), the following evidence can be considered.
